**Das Zürcher Verwaltungsgericht hat die geplanten kommunalen Mindestlöhne in Zürich und Winterthur gestoppt. Der Schweizerische Arbeitgeberverband begrüsst das Urteil, hat er doch seit langem vor den negativen Folgen kommunaler Mindestlöhne gewarnt.**

Das Zürcher Verwaltungsgericht hat heute entschieden, dass die geplanten kommunalen Mindestlöhne in den Städten Zürich und Winterthur nicht rechtens sind. [Mit seinem Entscheid](https://www.zh.ch/de/news-uebersicht/medienmitteilungen/2024/11/verordnungen-zur-einfuehrung-eines-mindestlohns-in-den-staedten-zuerich-und-winterthur.html) hat das Gericht klargestellt, dass kommunale Mindestlöhne nicht mit kantonalem Recht vereinbar sind. Auch wenn der Fall voraussichtlich weitergezogen wird, begrüsst der Schweizerische Arbeitgeberverband das Urteil des Zürcher Verwaltungsgerichts ausdrücklich.

[Der SAV hatte schon früh vor kommunalen Mindestlöhnen gewarnt](https://www.arbeitgeber.ch/arbeitsmarkt/kommunale-mindestloehne-das-lohndiktat-kommt-durch-die-hintertuer/). Mindestlöhne auf kommunaler Ebene würden unausweichlich zu einem Flickenteppich führen, da sowohl die Höhe der Mindestlöhne als auch deren Geltungsbereich je nach Gemeinde unterschiedlich wären. Die Folgen für die Arbeitgeber, die in mehreren Gemeinden tätig sind – und das sind nicht wenige – wären gravierend. So würde der administrative Aufwand angesichts der unterschiedlichen Lohnbedingungen massiv zunehmen. Diese Herausforderungen spüren bereits heute die überkantonal tätigen Unternehmen in den Kantonen mit Mindestlöhnen.

Eine weitere Verliererin kommunaler Mindestlöhne wäre die Sozialpartnerschaft. Im Schweizer Erfolgsmodell werden Löhne und weitere Regelungen aus guten Gründen auf betrieblicher oder sozialpartnerschaftlicher Ebene festgelegt. Mit der Einführung eines Mindestlohns – egal auf welcher föderalistischen Ebene – verschiebt sich der Verhandlungsspielraum von den Sozialpartnern, zu einer oftmals regulierungsfreudigen Politik. Vor diesem Hintergrund ist der heutige Entscheid insbesondere für den liberalen Arbeitsmarkt ein gutes Zeichen.

#### Über uns

Die Handelskammer und Arbeitgebervereinigung Winterthur HAW ist 1992 aus der Fusion der Kaufmännischen Gesellschaft Handelskammer Winterthur und dem Arbeitgeberverband Winterthur entstanden. Ihre Wurzeln gehen bis ins Jahr 1801 zurück. Die HAW prägte die wirtschaftliche Entwicklung der Stadt Winterthur und trägt bis heute dazu bei, dass Winterthur ein Wirtschaftsstandort mit gut ausgebauter Infrastruktur ist.
