**Das zwischen der Schweiz und der EU ausgehandelte Institutionelle Abkommen sichert die bilateralen Beziehungen und bildet die Grundlage für künftige Weiterentwicklungen. economiesuisse unterstützt deshalb den Abschluss des Abkommens auf Basis des vorliegenden Textentwurfs. Klarstellungen zum Umfang der Rechtsübernahmepflicht, zu den staatlichen Beihilfen und zur Rolle der Sozialpartner unter dem Entsenderecht der EU sind jedoch erforderlich.**

Der von der Schweiz und der EU ausgehandelte Text für ein Institutionelles Abkommen (InstA) ist nach Ansicht von economiesuisse ein ausgewogener Kompromiss mit vielen Pluspunkten. Der heute mit den bilateralen Abkommen erreichte Integrationsgrad im europäischen Binnenmarkt kann mit dem vorliegenden Vertragsentwurf gesichert werden. Im Unterschied zu blossen Erleichterungen über Freihandelsabkommen, gewähren gleiche Regeln in der Schweiz und der EU hiesigen Unternehmen ungehinderten Marktzugang.

**Stabiler Rahmen für bilaterale Beziehungen**  
Die bestehenden fünf Marktzugangsabkommen erhalten mit dem InstA einen stabilen Rahmen, in welchem mögliche Differenzen zwischen den Parteien geregelt werden können. Auch der Abschluss weiterer Marktzugangsabkommen – zum Beispiel im Strombereich – wird dadurch möglich. Dies sichert die Weiterentwicklung des bilateralen Wegs, stärkt die Rechtssicherheit und damit auch die Position der Schweiz im bilateralen Verhältnis zur EU.

Keines der verfügbaren Beziehungsmodelle (Isolation, umfassendes Freihandelsabkommen, EWR- oder EU-Mitgliedschaft) erweist sich als eine gleichwertige Alternative zum bilateralen Weg. Als eigentlicher Plan B nach der Ablehnung des EWR-Beitritts entstanden, hat er der Schweiz grossen Nutzen gebracht (siehe unser [dossierpolitik zum Wert des InstA](https://www.economiesuisse.ch/de/dossier-politik/der-wert-des-institutionellen-abkommens)) und den äussert vorteilhaften Zugang zum weltweit wichtigsten Handelspartner ermöglicht.

**Offene Fragen klären, Roadmap vereinbaren**  
Die noch offenen Fragen mit Blick auf den Vertragsentwurf sind nun noch zu klären. Konkret betrifft dies die Rechtsübernahme, staatliche Beihilfen und Fragen der Sozialpartnerschaft. economiesuisse fordert vom Bundesrat zudem, dass er die EU beim Wort nimmt: Nach der Unterzeichnung muss rasch eine Roadmap für Verhandlungen über alle Dossiers vereinbart und der gegenseitige Austausch institutionalisiert werden. Klar ist, dass eine Vielzahl der innenpolitisch heiklen Themen im bilateralen Verhältnis mit der EU (FlaM, Entsenderecht, Europäische Unionsbürgerrichtlinie, Koordination der Sozialsysteme) auch ohne das InstA fortbestehen werden. Mit dem Vertrag hätte die Schweiz aber eine bessere Verhandlungsposition als ohne. Auch eine Verschiebung der Verhandlungen ist keine Option. Ohne Unterzeichnung des Abkommens ist ab Juli 2019 mangels Nachführung der bestehenden Abkommen mit wirtschaftlichen Nachteilen für Schweizer Unternehmen zu rechnen.

#### Über uns

Die Handelskammer und Arbeitgebervereinigung Winterthur HAW ist 1992 aus der Fusion der Kaufmännischen Gesellschaft Handelskammer Winterthur und dem Arbeitgeberverband Winterthur entstanden. Ihre Wurzeln gehen bis ins Jahr 1801 zurück. Die HAW prägte die wirtschaftliche Entwicklung der Stadt Winterthur und trägt bis heute dazu bei, dass Winterthur ein Wirtschaftsstandort mit gut ausgebauter Infrastruktur ist.
