**Das institutionelle Abkommen mit der EU liegt als Entwurf seit geraumer Zeit vor und die Phantomdiskussion sollte eigentlich längst zu Ende sein. Aber noch immer halten sich Mythen, Behauptungen und Halbwahrheiten in der öffentlichen Debatte. Höchste Zeit, zu einer faktenbasierten Meinungsbildung zurückzukehren. economiesuisse hat sieben Mythen zum institutionellen Abkommen aufgespürt und mit den Unwahrheiten aufgeräumt.**

## MYTHOS 1: MIT DEM INSTA WIRD DER SCHWEIZ EU-RECHT AUFGEZWUNGEN.

**Fakt:** Im Institutionellen Abkommen (InstA) vereinbaren die Schweiz und die EU auf Basis eines völkerrechtlichen Abkommens und ohne Zwang, welches EU-Recht die Schweiz übernehmen wird und welches nicht. Bereits in den Bilateralen Abkommen I und II übernahm die Schweiz in den von diesen Abkommen betroffenen Bereichen das damals geltende EU-Recht. Die Schweiz kann zu jedem Zeitpunkt die Übernahme von EU-Recht verweigern, muss dann aber auch bereit sein, die Konsequenzen (verhältnismässige Gegenmassnahmen der EU) zu tragen. Im Gegenzug erhält die Schweiz einen privilegierten Zugang zum europäischen Binnenmarkt und hier ansässige Unternehmen und Bürger werden weiterhin gleich behandelt wie diejenigen aus dem EU-Raum. Ausserdem kann die Schweiz in Zukunft an den Vorbereitungsarbeiten von EU-Recht, das sie betrifft, teilnehmen und bei der Umsetzung in den EU-Gremien mitarbeiten.

## MYTHOS 2: DAS INSTA FÜHRT ZU MEHR RECHTSUNSICHERHEIT

**Fakt:** Das Gegenteil ist der Fall. In konkret vier Punkten schafft das institutionelle Abkommen Rechtssicherheit. Erstens bestimmen klare Regeln, dass nur Recht im Anwendungsbereich der fünf Marktzugangsabkommen der Bilateralen I (Personenfreizügigkeit, Technische Handelshemmnisse, Landwirtschaftsprodukte, Land- und Luftverkehr) von der Schweiz nachvollzogen wird. Zweitens wird die Schweiz neu an den Vorbereitungsarbeiten für künftiges EU-Recht, welches sie betrifft, einbezogen und kann diese in ihrem Sinne beeinflussen. Drittens können umstrittene Rechtsfragen durch das unabhängige Schiedsgericht geklärt werden. Und viertens können unverhältnismässige Gegenmassnahmen der EU in Zukunft durch das unabhängige Schiedsgericht geprüft und so verhindert werden.

## MYTHOS 3: EU-RECHT WIRD IN BRÜSSELER DUNKELKAMMERN GESCHRIEBEN UND IST FÜR DIE SCHWEIZ NICHT VORHERSEHBAR

**Fakt: **EU-Recht entsteht in einem transparenten Rechtsetzungsprozess. In einer Vernehmlassung werden die Bedürfnisse von Bürgern und Wirtschaft analysiert. Auf den Ergebnissen der Umfrage basiert die EU-Kommission ihren Rechtsvorschlag. Die Gesetzesarbeiten von EU-Parlament und EU-Rat sind transparent und dauern in der Regel zwei Jahre. Danach haben die Mitgliedstaaten zwei Jahre Zeit, die EU-Regeln in nationales Recht umzusetzen. Die Änderungen sind also vorhersehbar, von «Dunkelkammern» kann keine Rede sein. Dank dem institutionellen Abkommen hat die Schweiz ein Recht, sich bei den Vorbereitungsarbeiten zu Rechtsakten, die Teil der bilateralen Abkommen werden, zu beteiligen (Mitsprache- aber kein Mitentscheidungsrecht). Wir wissen also schon sehr früh, welche Rechtsentwicklungen auf uns zukommen und EU-Recht wird für uns noch vorhersehbarer.

## MYTHOS 4: MIT DEM INSTA IST DER BILATERALE WEG TOT

**Fakt:** Das Gegenteil ist der Fall. Das institutionelle Abkommen ermöglicht zum einen die Weiterführung und zum anderen den Ausbau des bilateralen Wegs. Seit Inkrafttreten der Bilateralen I und II hat sich das EU-Recht weiterentwickelt und an moderne Gegebenheiten angepasst. Das hat zur Folge, dass die Rechtsgrundlagen in der Schweiz und der EU nicht mehr dieselben sind. Dies erschwert eine erfolgreiche Handelsbeziehung. Wollen Schweizer Bürger und Unternehmen weiterhin von einem barrierefreien Zugang zum europäischen Binnenmarkt profitieren und die Errungenschaften des bilateralen Weges erhalten, ist eine Modernisierung des Schweizer Rechtrahmens unumgänglich. Eine Grundlage für diese Weiterentwicklung bietet das institutionelle Abkommen. Basierend darauf können die Schweiz und die EU ausserdem erfolgreich weitere Marktzugangsabkommen abschliessen.

## MYTHOS 5: MIT DEM INSTA HAT DIE EU EIN NEUES DROHMITTEL FÜR WEITERE SANKTIONEN IN DER HAND. DIE SCHWEIZ WIRD ZU EINER «SCHEINDEMOKRATIE»

**Fakt: **Das institutionelle Abkommen respektiert den direktdemokratischen Prozess der Schweiz vollumfänglich. Nach wie vor kann gegen die Umsetzung von EU-Recht in der Schweiz jederzeit das Referendum ergriffen werden. Die Schweizer Stimmbürger können – wie das bei jeder Volksabstimmung der Fall ist – allfällige Konsequenzen abwägen und ihre Entscheidung frei fällen, wie das beispielsweise auch bei der Abstimmung über einen EWR-Beitritt der Fall war.

## MYTHOS 6: DAS INSTA SCHAFFT EIN EINSEITIGES ABHÄNGIGKEITSVERHÄLTNIS ZWISCHEN DER SCHWEIZ UND DER EU

**Fakt**: Mit oder ohne institutionellem Abkommen spielt die EU schon allein aufgrund ihrer Grösse sowohl wirtschaftlich als auch politisch in einer anderen Liga. Für ein verhältnismässig kleines Land wie die Schweiz liegt die grösste Macht darin, gute Handelsabkommen mit mächtigeren Staaten abzuschliessen. Aus diesem Grund entspricht das institutionelle Abkommen grundsätzlich den Interessen der Schweiz. Falls die Schweiz EU-Recht nicht übernehmen will, kann die EU dank dem institutionellen Abkommen nicht mehr willkürlich Massnahmen ergreifen, welche die Schweiz wirtschaftlich besonders treffen (z.B. die Nichtanerkennung der Börsenäquivalenz). Die Massnahmen müssen auf den Marktzugangsbereich beschränkt und verhältnismässig sein. **Das institutionelle Abkommen schafft somit Recht anstelle von Macht.** Die Position der Schweiz gegenüber der EU wird mit dem institutionellen Abkommen gestärkt und die Beziehung wird symmetrischer als heute.

## MYTHOS 7: DER ZUGANG ZUM EU-BINNENMARKT IST AUCH MIT EINEM UMFASSENDEN FREIHANDELSABKOMMEN MÖGLICH

**Fakt: **Im Gegensatz zu den bilateralen Abkommen werden bei einem Freihandelsabkommen keine gleichen Rechtsgrundlagen vereinbart. Deshalb führt ein Freihandelsabkommen nur zu Erleichterungen beim Marktzugang, nicht aber zu einer vollständigen und sektorspezifischen Integration in den EU-Binnenmarkt. Heute haben Schweizer Bürger und Unternehmen dank der bilateralen Abkommen in den vereinbarten Bereichen einen uneingeschränkten Zugang zum EU-Binnenmarkt und werden gegenüber EU-Mitbewerbern gleichbehandelt. Bei einem umfassenden Freihandelsabkommen sind ein vollständiger Zugang und Gleichbehandlung nicht möglich. Eine solche Lösung anstelle der bestehenden bilateralen Abkommen würde für die Schweizer Bürger und Unternehmen deshalb einen massiven Verlust des Zugangs zum Binnenmarkt der EU bedeuten.

#### Über uns

Die Handelskammer und Arbeitgebervereinigung Winterthur HAW ist 1992 aus der Fusion der Kaufmännischen Gesellschaft Handelskammer Winterthur und dem Arbeitgeberverband Winterthur entstanden. Ihre Wurzeln gehen bis ins Jahr 1801 zurück.
