Mitarbeitende mit privaten Geldsorgen können für Unternehmen eine Belastung sein.  Sollen, dürfen oder müssen Arbeitgebende aktiv werden und Hilfe anbieten? Die HAW hat letztes Jahr der ZHAW einen Studienauftrag gegeben. Aufmerksam auf das Problem wird man im Betrieb meist wegen eines starken Leistungsabfalles, spätestens aber bei einer Lohnpfändung. Sollen, dürfen oder müssen Arbeitgebende aktiv werden und Hilfe anbieten? Explizite Handlungsanweisungen sind im OR nicht zu finden, auch in Rechtsprechung und Lehre wird dieses Thema fast gänzlich ausgeklammert.

Zu Lohnvorschüssen sind Arbeitgebende unter gewissen Voraussetzungen und in einem bestimmten Umfang verpflichtet (Art. 323 Abs. 4 OR), aber die Gewährung eines Darlehens ist ihnen ebenso freigestellt, wie Beratungsangebote oder präventive Schulungen. Wenn Arbeitgebende aber freiwillig Unterstützung anbieten, müssen sie die Persönlichkeitsrechte der Mitarbeitenden und die Grundsätze des Datenschutzes respektieren. Wollen sie z.B. Betreibungsregisterauszüge einfordern, um die finanzielle Situation von zu prüfen, bedarf es einer expliziten Einwilligung oder eines spezifischen Rechtfertigungsgrundes wie eine Tätigkeit mit erhöhtem Sicherheitsrisiko.

Das Weisungsrecht ist ebenfalls durch den Persönlichkeitsschutz der Arbeitnehmenden beschränkt und erstreckt sich i.d.R. nicht auf Bereiche ausserhalb des Betriebes. Es gibt auch keine Rechtsgrundlage, um Mitarbeitende zu zwingen, private Finanzprobleme mitzuteilen, selbst dann nicht, wenn diese eine Erkrankung mitverursacht haben.

Arbeitnehmende mit finanziellen Problemen reagieren bisweilen überreizt und beeinträchtigen dadurch das Arbeitsklima und die Zusammenarbeit im Betrieb. In solchen Fällen müssen Vorgesetzte einschreiten, denn sie haben eine rechtliche Pflicht, nicht nur bei Mobbing zu handeln, sondern auch bei konfliktgeladenen Situationen. Eine weitere Handlungspflicht lässt sich aus der Fürsorgepflicht nicht ableiten, da die Ursache ja im Privatbereich liegt. Nur bezüglich (Gesundheits-)Gefahren aufgrund der Situation am Arbeitsplatz besteht die Pflicht Massnahmen zu ergreifen (Art. 328 OR).

#### Über uns

Die Handelskammer und Arbeitgebervereinigung Winterthur HAW ist 1992 aus der Fusion der Kaufmännischen Gesellschaft Handelskammer Winterthur und dem Arbeitgeberverband Winterthur entstanden. Ihre Wurzeln gehen bis ins Jahr 1801 zurück. Die HAW prägte die wirtschaftliche Entwicklung der Stadt Winterthur und trägt bis heute dazu bei, dass Winterthur ein Wirtschaftsstandort mit gut ausgebauter Infrastruktur ist.
